NIA Launches UAPA Probe Into Flydubai Hijack Attempt After Indian Pilot Smit Machchhar Is Stabbed

The NIA has registered a case under UAPA and the Anti-Hijacking Act to investigate the alleged mid-air attack on Indian pilot Smit Machchhar aboard Flydubai Flight FZ1073 and determine whether a wider conspiracy was involved.

India’s National Investigation Agency (NIA) has launched a major investigation into an alleged hijacking attempt involving a Flydubai passenger aircraft after Indian Captain Smit Machchhar was reportedly stabbed by his Omani co-pilot during a flight over Saudi Arabia. The incident, which endangered the lives of passengers and crew members, has triggered serious security concerns and prompted the Centre to direct the federal anti-terror agency to investigate a possible wider conspiracy.

The NIA has registered a case under the Anti-Hijacking Act, 2016, and provisions of the Unlawful Activities (Prevention) Act (UAPA) to examine the circumstances surrounding the September 30 incident. The investigation will seek to establish what happened inside the cockpit, whether the alleged attack was part of a larger plan, and whether any other individuals were involved.

NIA Takes Over Investigation Into Mid-Air Attack

According to the information cited in the agency’s first information report (FIR), the Ministry of Home Affairs directed the NIA to investigate the incident because it involved an alleged attempt to hijack or crash a passenger aircraft and an attack on an Indian national outside the country.

The agency is empowered to investigate certain scheduled offences committed abroad when the case falls within its legal jurisdiction. The involvement of Captain Machchhar, an Indian citizen, is a key factor in the decision to initiate the investigation.

Officials are expected to examine the sequence of events, evidence from the aircraft, accounts provided by passengers and crew members, and any available information concerning the accused co-pilot’s intentions.

The investigation is also intended to determine whether the alleged assault was an isolated act or involved a broader criminal or terrorist conspiracy. However, the registration of a case does not itself establish the guilt of the accused or conclusively prove the motive behind the incident.

What Happened Aboard Flydubai Flight FZ1073?

The incident occurred on September 30 aboard Flydubai Flight FZ1073, which departed Dubai for Tel Aviv with 174 passengers and six crew members, according to the NIA’s FIR.

Captain Smit Machchhar, an Indian national, was operating the aircraft alongside an Omani first officer. During the journey, while the aircraft was flying over Saudi airspace near the Jordanian border, the first officer allegedly attacked the captain inside the cockpit.

The FIR states that the captain suffered deep cuts to his head and hands during the assault. Information provided to investigators indicated that the attack appeared to be an attempt to seize control of the aircraft or deliberately cause it to crash.

The alleged assault transformed a routine commercial flight into a serious aviation emergency, raising questions about cockpit security and the potential consequences of violence between flight-deck crew members.

Passengers and Crew Help Prevent a Potential Disaster

Following the alleged attack, passengers and crew members reportedly intervened and helped restrain the accused first officer. Their actions, alongside the response of the remaining pilots, were crucial in bringing the emergency under control.

Other pilots aboard the aircraft subsequently took control and diverted the flight to Prince Sultan bin Abdulaziz Airport in Tabuk, northwestern Saudi Arabia. The aircraft landed safely at approximately 10:45 am Gulf Standard Time, according to reports on the incident.

Saudi authorities reportedly arrested the accused co-pilot following the emergency landing.

The safe landing prevented the incident from escalating into a potentially catastrophic aviation disaster. Investigators will need to establish the precise sequence of actions in the cockpit, how control of the aircraft was maintained, and how the emergency response unfolded.

The case has also drawn attention to the importance of effective coordination among cockpit personnel, cabin crew, passengers and aviation authorities during an in-flight security threat.

Anti-Hijacking Law and UAPA Under Scrutiny

The NIA has invoked provisions of the Anti-Hijacking Act, 2016, and the Unlawful Activities (Prevention) Act in registering the case. These laws provide the legal framework for investigating serious offences involving aircraft hijacking and specified unlawful or terrorist activities.

The agency’s inquiry will examine whether the evidence supports allegations of an attempted hijacking, an effort to crash the aircraft, or other offences covered by the relevant laws.

Investigators may also examine the accused individual’s background, professional history, possible motive and any communications or other evidence relevant to the alleged attack. Any conclusions about intent, planning or wider connections will depend on the evidence gathered during the investigation.

The NIA’s involvement underscores the seriousness with which Indian authorities are treating an alleged attack on an Indian pilot during an international commercial flight.

International Security Questions Emerge

The incident has raised wider questions about aviation security, the screening of flight crew members and the measures available to prevent an individual operating inside a cockpit from threatening an aircraft.

Commercial aviation relies on strict professional standards, operational procedures and cooperation between crew members. An alleged attack by a fellow pilot presents a particularly complex security challenge because cockpit personnel are entrusted with responsibilities essential to the safety of everyone aboard.

The investigation may help authorities identify any gaps in existing safeguards and determine whether additional measures are necessary. However, any assessment of airline recruitment procedures, security checks or operational failures must be based on verified findings rather than assumptions.

The case also involves several jurisdictions, including India, Saudi Arabia, the United Arab Emirates and Israel, making international cooperation potentially important to establishing the full circumstances of the incident.

Investigation to Establish Motive and Wider Conspiracy

As the NIA begins its probe, the central questions remain what prompted the alleged attack, whether the accused intended to hijack or crash the aircraft, and whether anyone else had knowledge of or involvement in the incident.

The agency will have to assess witness statements, documentary evidence and other available material before drawing conclusions. The legal proceedings and the investigation’s findings will determine the strength of the allegations.

For now, the safe landing of Flight FZ1073 stands as a critical outcome of an alarming mid-air emergency. The case is also a reminder of the potentially devastating consequences of violence aboard a passenger aircraft.

With the NIA now investigating the matter under anti-hijacking and anti-terror legislation, the probe is expected to focus on accountability, motive and whether the incident points to a wider security threat.
